California DUI arrests What occurs after you have been arrested for DUI in California? The officer is needed by law to right away send a copy of the filled out notice of suspension or revocation form and any driver license taken into possession, with a sworn description to the DMV offices according to California DUI laws and penalties. After the California DUI arrests, the DMV routinely conducts an administrative check that includes an assessment of the officer's report, the suspension or revocation order, and any assessment results. If the suspension or revocation is preserved during the administrative review, you may request a hearing to contest the suspension or revocation following the California DUI arrests. You have the right to request a hearing from the DMV in California inside 10 days of acceptance of the suspension or revocation order. If the review shows there is no basis for the suspension or revocation, after the California DUI arrests, the action will be set aside. You will be told by the DMV in writing only if the suspension or revocation is set to the side following the administrative review. |
